Terms and Conditions

The following legal agreements reached between you and the "Global Sense Cyprus Limited" (hereinafter - Global Sense) and govern your use of the mobile application "Palmist" (hereinafter - the Application). To accept these conditions click "I agree" or similar button, where this option is provided by the Application. If you do not agree to these terms, do not click "I agree" and do not use the application. By downloading, accessing and/or using this mobile application you signify that you have read, understand and agree to be bound by all of the terms and conditions as set forth in this Terms of Use Agreement (hereinafter - the Agreement) you agree to observe the conditions and have responsibility for their violation. Terms and conditions of the Agreement are essential and equally binding for all.

Definitions

Whenever capitalized in this Agreement:

Global Sense – «Global Sense Cyprus Limited» (the owner of the Application), as well as persons authorized by the owner of Applications for special use of Application, including management, and acting on behalf of the owner of the Application.

Account – account on the server Global Sense, containing the information required to identify in the Application, as well as tools for working with the information.

Data – identification data (name / nickname, gender, date of birth, city, country, data of processing photos of palms and fingers).

Order – generated user request for information about the features of his/her character, personal relationships and professional qualities.

Agreement – this document, including any attachment as well as a license agreement between you and Global Sense, concluded on the basis thereof. In the Agreement You and Global Sense individually referred to as "Party" and together - the "Parties".

Materials or Content – the result of the provision of services by the Application submitted in the form of photos, video, audio, graphic and text information.

Parameters – biometric data, the parameters of a person's palm (length and width of the palm, finger size and phalanges, types of finger patterns, sizes of main palmar lines) used for the provision of the Services by the Application.

User – any natural person who accept the agreement by acceptance.

Application – a software program, revealing features of a person's character, personal relationships and professional qualities by processing of biometric data. The software is intended for installation and use on your iOS Device.

Website – a web site provided by Global Sense, located at : www.globalsense.io.

Device iOS – tablet (iPad), smartphone (iPhone) or any other device that allows you to use the application according to its intended purposes.

Service – receiving, processing and analysis of the parameters, as well as the provision of information (materials) about the features of a person's character, his/her personal relationships and professional qualities. Also providing the ability to find compatible people (based on the analysis of the hands parameters) and communicate with them.

Conditions – all the provisions, terms and conditions described in this Agreement.

Subject of the Agreement

In accordance with the terms of this Agreement Global Sense grants you non-exclusive property rights to use the Application in a manner determined by this Agreement: download and install the application on the iOS device, run applications and use its functionality. The Application and all its content presented in any form, as well as the materials are protected by copyright and are protected under the copyright laws.

You agree not to reproduce, duplicate, copy or re-sell the Application or any part of the Application save (sublicense) as may be permitted by these Terms of Use. Non-exclusive license is granted to you to use without restriction in the territory. Global Sense has the right to use the Application in a manner determined by this Agreement, and reserves the right to issue a similar non-exclusive licenses to third parties.

You are Prohibited to:

sublicense, sell, assign, give in use and lease, export, import, distribute, transmit, or otherwise grant rights to the application to third parties;
undertake, encourage, permit or authorize the modification, creation of similar products or improvements, translation into other languages, engineering analysis for reproductive purposes, decompile, disassemble, decode, emulation, violation of the integrity of the protection system, recovery or attempts to recover the source code or the Application protocol, or any of its parts or the functionality of the Application;
delete, hide and alter any copyright notices or other copyright notices included in the Application;
use or encourage the use of Applications (or any part of it) in commercial purposes or to offer for commercial purposes or services to third parties. The above limitation shall not apply to personal-use application;
distribute in any form or by any means Submissions from Global Sense.

Conditions of Use

This Agreement is a public offer and shall come into force from the date of its acceptance by you.

To use the application and all of its functions, you have to accept (take) this Agreement by clicking "I agree" or agree to the Agreement using any other proposed method. After acceptance of this Agreement, you can start using the Application.

You cannot accept the Agreement in the following cases:

if you do not have the legal right to use the Application in the country where you live in or in which you reside;
if you have not reached the age at which you have the right to enter into an agreement with Global Sense according to the law.

If you do not agree with these Terms of Use, do not click “I agree” and cease downloading, installing or using the Application immediately.

While using the Application to receive materials about your character, personal relationships and professional qualities you will be asked to fill in the following fields "Username", "Date of Birth", "Sex", "Sexual Preferences","Country", as well as image fields for pictures of left and right palms and image fields for photos of fingers of both hands. These data is the identity of your Account.

You do not have to give your real personal data. Global Sense does not collect and store your personal data and does not identify you as an individual. We use the data in the identification section for Statistics (collecting information on the number of users of the application by sex, age and geography) and for your identify on subsequent uses of the Application.

We recommend to save/store data that you specify when creating the Account for the possibility of readmission (free) of the results in case of the removal of the Account or removal (reinstallation) the Application from your iOS device.

Sending photos of your palms and fingers from your iOS device to the server Global Sense may be done only in your explicit consent when scanning by selecting "Store photos of my palms and fingers on the server for access from other devices, as well as after signing out of the account or app deleting”. If you do not agree to send photos of your palms and fingers, then do not put a mark in front of the words "Store photos of my palms and fingers on the server for access from other devices, as well as after signing out of the account or app deleting". In this case, from your iOS device will be sent only the data of processing the photos (parameters), but not the photos.

Encoded parameters come to Global Sense, and after the processing of the parameters available materials formed in accordance with the received parameters will be sent. The result of services (Materials) can be sent an unlimited number of times according to your request.

You can use the materials comprehensively or in trial mode. The material presented in trial mode is a shortened form of your materials and are provided to you free of charge. To use the materials comprehensively, you will need to make a payment in accordance with the terms of this Agreement.

For acquisition comprehensive Materials you need to have at least 100 MB of free space on your iOS device. If at the time of services there is not enough free space on your iOS device, you will not be able to get materials in an abbreviated or full.

If you delete (reinstallation) of the Application you need to enter the same the data (including pictures of palms and fingers) for the recovery of materials, which were introduced during the initial provision of services. If you delete the Account or delete (reinstallation) the Application from your iOS device and loss of data you input, Global Sense will not be able to identify you. Access to your content will be impossible. In this case, for the recovery of materials you will need to re-make the Account.

The service is considered provided after the complete load of the Materials on your iOS device. If, for technical reasons, loading of materials on your iOS device fails, immediately contact technical support support@globalsense.io . If, within 24 hours of the Service motivated complaints about the quality of the Services are not received, Global Sense has the right to examine the claims received in violation of the mentioned period at its discretion.

Ticket of service is not drawn up.

Personality characteristics provided to you as a result of the provision of the Service, contains both positive and negative assessment of your qualities and can be regarded as abusive. Using the Application, you consent to receiving any assessment of your qalities. If you do not agree with this condition, do not accept the Agreement, do not click "I agree" and do not use the Application.

You agree to use the application at your own risk, as well as the fact that Global Sense is irresponsible for Materials that may be considered by you as offensive, indecent or objectionable.

The Application works by using the Internet, in this regard, you shall bear the expenses for the used traffic. It is your responsibility to complete awareness of these issues, paying for possible roaming and other costs charged by your ISP in your area.

By using the "Search for Compatible People" Service, you agree that you will not:

• use the Service for any purpose that is illegal or prohibited by this Agreement;

• use the Service to harm the Palmist;

• post any Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;

• post any Content that contains hate speech, threats, sexually explicit or pornographic content;

• post any Content that encourages violence;

• spam, extort money or defraud any user;

• impersonate any person or entity or post any image of another person without his or her permission;

• post any Content that violates anyone's rights, including rights of publicity, privacy, copyright, trademark or other intellectual property or contract rights;

• solicit passwords for any purpose or personal information for commercial or illegal purposes from other users, or distribute another person's personal information without his or her permission;

If you breach this Agreement, Global Sense reserves the right to terminate your account without refunding any purchases.

Global Sense cannot guarantee that all Content will comply with this Agreement. If you see content on the Service that violates this Agreement, please let us know.

Cost and Payment

The cost of paid services which are available through the Application, determines on the basis of tariffs of Global Sense, set out in the relevant section of the Application. Payment for services performed on the conditions of "Terms of sale for «iTunes Store »,« Mac App Store »,« App Store »and« iBooks Store ».

Rights and Liabilities of the Parties

Global Sense is obliged to:

properly and efficiently provide the services listed in the Application;
examine the claims of Users and take measures for debugging in the Application in a timely manner;
ensure the confidentiality of your data;

Global Sense is justified to:

implement moderation Applications independently, introduce new services, change the terms, cost, payment methods and the order of services with advanced notice of the User or without;
require the following of procedures of the use of Application set out in the Agreement.
engage third parties to perform their obligations under the Agreement, as well as to use the services / work of third parties, which are necessary for the proper provision of services under the Agreement.

You agree:

to be bound by the terms of this agreement, as well as pay for the Services on the terms and conditions provided in the Agreement;
to regularly check out the information concerning the provision of services available in the Application;
not to use the Application for the dissemination of information, the content of which contradict the applicable laws of the Republic of Cyprus or international law;
not to use the Service or Application for publication, storage, distribution and transmission of data in any form, if the copyright, related or other exclusive rights belong to third parties;
not to use the Service or Application for publication, storage, distribution and transmission of data in any form, if data contains materials and information, disclosure, dissemination or other use of which is prohibited or restricted by law;
not to attempt to damage, disable, overburden, or impair servers or networks of Global Sense;

You have the right to make proposals to improve the application.

Modification and Termination of the Agreement

This Agreement shall come into force after the acceptance by you and is valid for five (5) years. If none of the Parties declares the termination of the Agreement on seven (7) days prior to its expiration date by written notification, the Agreement will automatically renew for successive one (1) year terms, unless sooner terminated in accordance with this Agreement.

Global Sense may revise the Agreement at any time and without notice. Changes will be posted on the Website in the "Regulations" of the Application. The changes take effect from the date of publication. Your continued use of the Application shall be considered your acceptance of the revised Agreement. If you decline the revised Agreement, you may terminate this Agreement.

The Agreement may be terminated by you at any time. To do this, stop using the Application and remove it from the iOS devices.

By the decision of Global Sense the Agreement may be terminated unilaterally in the following cases:

for violating the terms of the Agreement in any manner;
if Global Sense has a reason to believe that the Application is used by you for violation of the law or infringement of the rights of third parties;
if Global Sense has a reason to believe that the Application is used by you for fraudulent purposes;
immediately (in the opinion of Global Sense) if it is necessary due to changes in legislation, and if required by the public authorities;
for any other reason.

Responsibilities of the Parties

This Agreement shall be governed by and shall be construed in accordance with the laws of the Republic of Cyprus. In case of failure of proper execution of the Agreement by the Parties the Parties respond for violation of the Agreement covenants in accordance with the legislation of the Republic of Cyprus.

You are solely responsible for nonobservance of the terms of intellectual property; for all activities that occur on your behalf, including unauthorized acts of third parties due to noncompliance of the confidentiality of data, or other information of private nature, as well as for the consequences of such actions.

The User is also solely responsible for all transactions and activities undertaken by anyone or anything with any account registered in the User’s name, whether authorized or unauthorized. Global Sense is not responsible for damage of the Application by third persons.

Parties are released from responsibility for obligation default in case of force majeure ("force majeure"): natural disasters, fires, accidents, power outages, failure of work of the Internet, routing system failures, failures caused by hacker attacks etc .

Limitation of Liability. No Warranties

You expressly acknowledge and agree that:

you use the Application fully at your sole risk. Any Services are provided by the Application "as is" and "as available";
Global Sense does not warrant that (1) the service will meet your requirements; (2) the Application will be constantly available, or available at all; (3) that the information in this Application is complete, true, accurate, or reliable; (4) your opt-out choices will be successfully executed in all cases; (5) the services will be delivered smoothly, on time, correctly and safely; (6) the results obtained by the use of the Application to be accurate or reliable; (7) the quality of services, information and other materials obtained or purchased by the user via the Application or the Website will meet your expectations, (8) any information stored or transmitted through the Application or Services will not be lost, corrupted or damaged; and (9) any errors or defects in the Application will be corrected.
no advice or information, obtained by you orally or in writing from Global Sense or through the services, do not impose guarantees on Global Sense of other than those specified in the Agreement.

You fully understand and acknowledge that Global Sense is not responsible for any direct, indirect, incidental, special, consequential or cash punishment damages, including lost profits, damages from use, loss of data or any other intangible losses, damage to reputation or other damages (even if Global Sense has been notified of the possibility of such damages) arising from: (1) the use of or inability to use the Application; (2) changes in the conditions of the Agreement, (3) unauthorized access to your data; (4) any other event that is relevant to use of the Application.

Notices and notifications

The Parties unconditionally agree that all correspondence, notices and notifications received from e-mail addresses (on address) which are specified in the Agreement, shall be deemed delivered to the addressee in an appropriate form and shall be legally binding.

The Parties shall timely check the correspondence that comes to their email address. All risks associated with the onset of adverse effects due to non-compliance with this paragraph shall be on a Party susceptible of the violation.

Other Conditions

All disputes related to the execution of the Agreement the Parties shall resolve through negotiation and directions of claims.

If the parties fail to resolve all outstanding issues through negotiations and directions of claims, all disputes relating to this Agreement including those related to its conclusion, modification, termination, execution shall be settled in the courts located within the Republic of Cyprus in accordance with the legislation of the Republic Cyprus.

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Cyprus. Issues not regulated by the Agreement, shall be settled in accordance with the laws of the Republic of Cyprus.

If any of the terms of the Agreement becomes null and void, is deemed unlawful, or is excluded from the Agreement, it does not entail the invalidity of the other terms of the Agreement, which remain valid and binding upon the Parties.
